Privacy Policy and Terms of Service 

1. PRIVACY POLICY

We know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy. By using recoveryfoundation.com, you are accepting the practices described in this Privacy Notice. Recovery Foundation. ( “we”, “us”, “our”) needs to collect some information about you, and this Privacy Policy is where we describe the information we collect, what we do with it, and how you can manage and control the use of your information. By using or interacting with the Service, you are entering into a binding contract with us and consenting to the use of your information as explained in this Privacy Policy. At no time will we buy, sell or trade your personal information to third parties. If you don’t agree with these terms, then please don’t use the Service.

 

A. The information we collect

A.1 Registration data

When you sign up for the Service, we may collect information we ask you for, like your username, password, e-mail address, postal code, and country. We may also collect information you voluntarily add to your profile, such as your mobile phone number and fax number. If you connect to the Service using your Facebook credentials, you authorize us to collect your authentication information, such as your username, encrypted access credentials, and other information that may be available on or through your Facebook account, including your name, profile picture, country, hometown, e-mail address, date of birth, gender, friends’ names and profile pictures and networks. We may store this information so that it can be used for the purposes explained in Section B and may verify your credentials with Facebook.

A.2 Usage, log data & cookies

When you use the Service, we automatically collect certain information, including: (i) information about your type of subscription and your, interactions with the Service, including with workshops you have signed up for, Third Party Applications (as defined in the Terms of Service) and advertising, products and services which are offered, linked to or made available on the Service; (ii) the details of the queries you make; (iii) User Content you post, upload and/or contribute to the Service (as defined in the Terms of Service); (iv) technical data, which may include the URL you are coming from, your IP address, unique device ID, network and computer performance, browser type, language and identifying information and operating system; and (v) location information. If you have connected your account to Facebook, we may receive similar information related to your interactions with the Service on Facebook. We may use cookies and similar technologies to collect this information and you can learn more about such use at the bottom of this Privacy Policy. We may store this information so that it can be used for the purposes explained in Section B. In order to ensure the integrity of your personal information, all your data is stored in our secure database system.

A.3 Payment data

When you sign up for workshop, Public or otherwise, or make other purchases through the Service, your credit card information and other financial data that we need to process your payment are collected and stored by third party payment processors. We may collect some limited information, such as your postal code, mobile number and details of your transaction history. In addition, the third party payment processors generally provide us with some limited information related to you, such as a unique token that enables you to make additional purchases using the information they’ve stored, and your card’s type, expiration date, and last four digits. If you choose to pay by invoice, Recovery Foundation may need to collect and transfer additional information, like your name, date of birth and phone number, to our invoicing service provider to enable credit checks and send you invoices. The use of your data by our invoicing service provider is subject to its privacy policies.

B. How we use the information we collect

We may use the information we collect, including your personal information, to: (i) provide, personalise, and improve your experience with the Service and products and services made available through the Service; (ii) ensure technical functioning of the Service and products and services made available through the Service, develop new products and services, and analyse your use of the Service, including your interaction with applications, advertising, products and services that are made available, linked to or offered in the Service; (iii) communicate with you for Service-related purposes, including promotional e-mails or messages; (iv) enable and promote the Service, including features and content of the Service and products and services made available through the Service, such as sharing, user interactions, notifications and suggestions, and integration with third party services; (v) enforce this Privacy Policy and the Terms of Service, including to protect the rights, property or safety of Recovery Foundation, users or any other person and the copyright-protected content of the Service; and (vi) as otherwise stated in this Privacy Policy.

What Personal Information About Customers Do You Gather?

The information we learn from customers helps us personalize and continually improve your user experience at our site. Here are the types of information we gather.

 

a) Information You Give Us

We receive and store any information you enter on our Web site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, customizing future usage by you, improving our site, and communicating with you.

 

b) Automatic Information

We receive and store certain types of information whenever you interact with us. For example, like many Web sites, we use “cookies,” and we obtain certain types of information when your Web browser accesses our site. A number of companies offer utilities designed to help you visit Web sites anonymously. Although we will not be able to provide you with a personalized experience if we cannot recognize you, we want you to be aware that these tools exist.

 

c) E-mail Communications

To help us make e-mails more useful and interesting, we often receive a confirmation when you open e-mail from us if your computer supports such capabilities. We also compare our customer list to lists received from other companies, in an effort to avoid sending duplicate messages to our customers. If you do not want to receive e-mail or other mail from us, please contact us.

 

d) Information from Other Sources

For reasons such as improving personalization of our service (for example, providing better product recommendations or special offers that we think will interest you), we might receive information about you from other sources and add it to our account information. We also sometimes receive updated delivery and address information from our shippers or other sources so that we can correct our records and deliver your next purchase or communication more easily.

Do You Share the Information You Receive?

 

Information about our customers is an important part of our business, and we share customer information only with subsidiaries of Recovery Foundation Workshops and  its affiliates, and as described below.

 

a) Affiliated Businesses We Do Not Control

We work closely with our training content vendors. When another business is involved in your transactions, we share customer information related to those transactions with that business.

 

b) Agents

We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.

 

c) Promotional Offers

Sometimes we permit other businesses to make offers to our customers which we believe will be of interest. If you do not want to receive such offers, please contact us

 

d) Business Transfers

As we continue to develop our business, we might sell or buy assets. In such transactions, customer information generally is one of the transferred business assets. Also, in the event that we or substantially all of our assets are acquired, customer information will of course be one of the transferred assets.

 

e) Protection of Recovery Foundation Workshops

We release account and other personal information when we believe release is appropriate to comply with law; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of ourselves, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

 

f) With Your Consent

Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.

Conditions of Use, Notices, and Revisions

If you choose to visit recoveryfoundation.com, your visit and any dispute over privacy is subject to this notice and our conditions of use, including limitations on damages, arbitration of disputes, and application of the law of the state of Utah. If you have any concern about privacy at our web site, please send us a thorough description to customer service, and we will try to resolve it. Our business changes constantly. This notice and the conditions of use will change also, and use of information that we gather now is subject to the Privacy Notice in effect at the time of use. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Web site frequently to see recent changes.

2. ACCEPTANCE OF TERMS OF SERVICE

This service is provided to you, subject to the following Terms of Service (“TOS”), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at: http://www.recoveryfoundation.com/TOS. In addition, when using particular services directly or through distributors and affiliates, you, and Recovery Foundation Workshops shall be subject to any guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the TOS. Recovery Foundation Workshops also may offer other services from time to time that are governed by different Terms of Services. These TOS do not apply to such other services.

3. DESCRIPTION OF SERVICE

The system may provide users with access to a collection of on-line resources, including various training tools, online forums, a knowledgebase of information, personalized content and branded programming through its network of properties (the “Service”). Unless explicitly stated otherwise, any new features that augments or enhances the current Service, including the release of new Recovery Foundation Workshops, shall be subject to the TOS. You understand and agree that the Service is provided “AS-IS” and that Recovery Foundation Workshops assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications, user data, or personalization settings. In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Please be aware that we have created certain areas on the Service that contain adult or mature content. You must be at least 18 years of age to access and view such areas.

4. YOUR REGISTRATION OBLIGATIONS

In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service’s registration form (such information being the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Recovery Foundation Workshops  have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). We are concerned about the safety and privacy of all its users.

5. MEMBER CONDUCT

 

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Recovery Foundation Workshops, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Service. Recovery Foundation Workshops do not control the Content posted via the Service and, as such, do not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Recovery Foundation Workshops be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Service. You agree to not use the Service to:

 

a. upload, post, email or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

 

b. harm minors in any way;

 

c. impersonate any person or entity, including, but not limited to, a Recovery Foundation Workshops  official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

 

d. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

 

e. upload, post, email or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

 

f. upload, post, email or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (“Rights”) of any party;

 

g. upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;

 

h. upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

 

i. disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges;

 

j. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

 

k. intentionally or unintentionally violate any applicable local, state, national or international law.

 

l. “stalk” or otherwise harass another; or

 

m. collect or store personal data about other users.

 

You acknowledge that Recovery Foundation Workshops do not pre-screen content, but that Recovery Foundation Workshops and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, Recovery Foundation Workshops and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Recovery Foundation Workshops  or submitted to Recovery Foundation, including without limitation information in Recovery Foundation Workshops  Message Boards, Clubs, and in all other parts of the Service. You acknowledge and agree that Recovery Foundation Workshops may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Recovery Foundation Workshops, its web site users and the public. You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

6. INDEMNITY

 

You agree to indemnify and hold Recovery Foundation Workshops  and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

 

7. NO RESALE OF SERVICE

 

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

8. DEALINGS WITH ADVERTISERS

 

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Recovery Foundation Workshops shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

9. RECOVERY FOUNDATION WORKSHOPS PROPRIETARY RIGHTS

 

You acknowledge and agree that the Service and any necessary software used in connection with the Service (“Software”) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Recovery Foundation Workshops  or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part. Recovery Foundation Workshops grant you a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by Recovery Foundation Workshops for use in accessing the Service.

10. DISCLAIMER OF WARRANTIES YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

 

a. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. RECOVERY FOUNDATION EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

 

b. RECOVERY FOUNDATION WORKSHOPS  MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

 

c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

 

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RECOVERY FOUNDATION WORKSHOPS OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS. 18. LIMITATION OF LIABILITY YOU EXPRESSLY UNDERSTAND AND AGREE THAT RECOVERY FOUNDATION WORKSHOPS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RECOVERY FOUNDATION WORKSHOPS  AND CAREERTRACK HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. 19. EXCLUSIONS AND LIMITATIONS SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 17 AND 18 MAY NOT APPLY TO YOU. 20. SPECIAL ADMONITION FOR SERVICES RELATING TO FINANCIAL MATTERS If you intend to create or join any service, receive or request any news, messages, alerts or other information from the Service concerning companies, stock quotes, investments or securities, please read the above Sections 17 and 18 again. In addition, for this type of information particularly, the phrase “Let the investor beware” is apt. The Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. Recovery Foundation Workshops shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted via the Service, and shall not be responsible or liable for any trading or investment decisions made based on such information.

 

11. NOTICE

 

Notices to you may be made via either email or regular mail. The Service may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to you generally on the Service.

 

12. TRADEMARK INFORMATION

 

Recovery Foundation Workshops, the Recovery Foundation logo, and Creating Harmony Workshops, all trademarks and service marks, and other recoveryfoundation.com logos, workshops and product and service names are trademarks of AIF Training Group. Without Recovery Foundation Workshops prior permission, you agree not to display or use in any manner.

 

13. COPYRIGHTS and COPYRIGHT AGENTS

 

Recovery Foundation Workshops respect the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information: a. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; b. a description of the copyrighted work that you claim has been infringed; c. a description of where the material that you claim is infringing is located on the site; d. your address, telephone number, and email address; e. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; f. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. 14. GENERAL INFORMATION

 

The TOS constitute the entire agreement between you and Recovery Foundation Workshops and govern your use of the Service, superseding any prior agreements between you and Recovery Foundation Workshops. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The TOS and the relationship between you and Recovery Foundation Workshops shall be governed by the laws of the State of Utah without regard to its conflict of law provisions. You and Recovery Foundation Workshops agree to submit to the personal and exclusive jurisdiction of the courts located within Tooele County, Utah. The failure of Recovery Foundation Workshops to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.

 

15. VIOLATIONS

Please report any violations of the TOS to our Customer Care group.

All of our Workshops are 100% SATISFACTION GUARANTEED!  We’re confident that our workshops will provide you with the improved skills and techniques you expect.  If for any reason you are dissatisfied, send us a letter (Attn: Customer Service) within 30 days of your workshop attendance stating the reason you were not satisfied, and we’ll arrange for you to attend another one of our workshops or receive a full refund.

 

Our Cancellation Policy for Public Workshops:

You may cancel your registration up to 8 business days before the program. Your registration fee will be refunded less a cancellation fee of 10%. If you need to cancel less than 8 business days prior to the program you may (1) send a substitute from your organization or (2) transfer your registration fee to another program of your choice that is scheduled within 12 months of your original event. Please note that if you don’t cancel and don’t attend you are still responsible for payment. Substitutions may be made at any time.
